Marijuana Possession

Potential Penalties for a Marijuana Conviction

- A jail sentence of up to 30 days in jail
- A fine of up to $500
The penalties increase significantly if you are convicted for a second possession offense. You could face up to12 months in jail and a fine of up to $2,500.
Additional Penalties to Consider
If convicted, your criminal record will show that you were found guilty of a misdemeanor in Virginia. Such a record can trigger additional penalties outside of the court system, including difficulty securing or maintaining employment, obtaining an education, securing housing and much more.
In addition, there is a mandatory six month driver’s license suspension for an initial conviction of marijuana possession. We will do everything in our power to limit the effect your experience with the criminal justice system has on the rest of your life, including preserving your privilege to drive.
